NSW:Hammer murder mum released from prison

SYDNEY, Aug 15 AAP - Eighteen years in prison have ended for Gunn-Britt Ashfield, the
woman who murdered her six-year-old son with a hammer and phone book while his siblings
watched.

The mother, 43, who changed her name to Angelic Karstrom while serving 18 years of
a 19-year maximum sentence was released on parole on Monday from the Dillwynia Correction
Centre, within the John Morony Correctional Complex northwest of Sydney.

Karstrom and her partner Austin Allan Hughes pleaded guilty to the 1993 bashing murder
of her son John Ashfield, which her four other children were forced to watch.

She exited the prison around 11am (AEST) wearing a black trouser suit and a white collared
shirt, and was escorted to a waiting vehicle by police.

Karstrom must comply with a number of parole conditions, including electronic monitoring,
drug and alcohol testing, curfews and ongoing counselling.

She is banned from living in or visiting the Illawarra and Hunter regions, where her
family lives, and may not be in the company of anyone under the age of 16.

At the family's request, she is prohibited from visiting the grave of her murdered son.

Karstrom is also banned from contacting Hughes, who was released in December 2009 after
serving 16 years for the crime.

Her daughter, Melissa Ashfield, 21, opposed her mother's release during a July hearing
of the NSW Parole Board.

In granting her parole, the board determined it would be better to monitor her in the
community for a year under strict conditions.

Ms Ashfield on Monday was aware her mother was scheduled for release but said she was
still upset about the outcome.

"I'm very angry," she said to AAP.

In July, outside the parole hearing, she recalled details of John's murder.

"Way before my brother's come home from school, it was a lot of tension, a lot of yelling,
a lot of flaring," Ms Ashfield said.

"And before you know it, my brother was the target.

"They started hitting him, punching him.

"They both took turns putting the phone book on his head, smashing it with a hammer.

"They both bashed him for two and a half hours.

"My brother's screaming, saying, `I'm sorry, I'm sorry,' and she kept going. She could've
easily said, `Stop.'

"But it went further. She let Austin put one of my dresses on my brother and mocked
him before ... he was dead."

Ashfield and Hughes pleaded guilty and were jailed for 21 years but had their sentences
reduced on appeal to 19 years, with a minimum of 14.

The parole board had denied Ashfield parole four years in a row from 2007.

Vic: Feltex to close Melbourne plant by June

MELBOURNE, Feb 2 AAP - The new owner of carpetmaker Feltex has announced today that
it will honour employee entitlements in full when it closes its manufacturing plant and
distribution warehouse in Melbourne.

The closure of the Brooklyn plant, in Melbourne's south-west, which was planned for
the end of June, will result in 110 job losses.

The move was part of a rationalisation of Feltex Carpets which was bought by Geelong
based the Godfrey Hirst group late last year.

Godfrey Hirst spokesman Jim Walsh said all employee entitlements would be met.

He said Feltex was in receivership when it was purchased by Godfrey Hirst on November 30, 2006.

"We have undertaken a full review of Feltex and we are committed to fully overhauling
the Feltex operations to ensure it has a viable and vibrant long-term future in carpet
manufacturing in Victoria," Mr Walsh said.

Three hundred people were employed at Feltex when it was bought by Godfrey Hirst.

Mr Walsh said the closure would be staggered over the next five months to allow Godfrey
Hirst to work with employees on the timing of the redundancies, and the relocation of
other staff to other plants.

Under the plan the twisting and heatsetting operations will be transferred to Godfrey
Hirst's plant in North Geelong.

Feltex's national distribution centre will be transferred to Godfrey Hirst's plant
at Laverton, in Melbourne's southwest by June 30.

The company's pattern printing and laminating operation at Tottenham will be closed
within two months.

Comment was being sought from the Textile Clothing and Footwear Union of Australia.

SYDNEY, April 18 AAP - Colourful Nationals MP Barnaby Joyce has been approached by
colleagues to run against key independent Tony Windsor at the next federal election -
an offer he'd be "foolish" not to take, he says.

The Queensland senator has told the Nine Network that he would consider taking on Mr
Windsor in his central NSW seat of Tamworth and moving to the lower house, after being
sounded out by key coalition political figures.

"Of course I would consider it - I'd be foolish not to," the Tamworth-born, Queensland-based,
opposition spokesman for regional development told Nine.

Mr Windsor holds Tamworth by a healthy margin of 21.5 per cent, but with a voter backlash
expected after his 2010 political deal with Prime Minister Julia Gillard to help Labor
form a minority government, the seat may be in reach of the Nationals.

Senator Joyce said his pre-selection for Tamworth wasn't locked in.

"The only decision I can make is whether I'd be open to going there and I said I would be.

"It's like going to Kate and Will's wedding - you wait for the invite, you don't just
decide to turn up."

The Nationals senator denied mounting a personal campaign against Mr Windsor.

"It's not the case of taking on a certain person," he said.

"It's not about a personality issue, it's about trying to deliver the best policies,
the best outcomes and give the best representation."

The plans to parachute Senator Joyce into the lower house seat come after a Neilsen
poll published on Monday showed the coalition had opened a 56 to 44-point lead against
Labor.

Mr Joyce, 44, was first elected as a Nationals candidate to the Senate in 2004.

He is an accountant based in St George in southwest Queensland.

If he won the seat of New England he could be expected to challenge Warren Truss for
the leadership of the Nationals.

11 January 2011 - S&P on Monday set a B- corporate credit rating with a "stable" outlook, on a preliminary basis, to US Internet service provider Cogent Communications Group (NASDAQ:CCOI).
At the same time, the service rated at B- with a recovery rating of 4 the company's USD150m (EUR116m) notes due 2018. The recovery rating denotes average (30%-50%) recovery prospects in a payment default.

"The preliminary ratings on Cogent reflect what we consider its highly leveraged financial risk profile after the proposed debt transaction," said Standard & Poor's credit analyst Gregg Lemos- Stein, "including our expectation for high debt burden and only marginally positive free operating cash flow for the next few years."

The rating also incorporates the firm's "vulnerable" business risk profile, given its high churn and competitive pressure.

Still, analysts expect some revenue expansion over the next couple of years due to clients' increasing use of online services that would lower the company's leverage to 5x from the end-December 2010 level of 5.6x.

FED:Labor holds narrow lead in final polls

SYDNEY, Aug 21 AAP - Labor is holding onto a narrow lead over the coalition in the
final opinion polls of the federal election in one of the tightest races in living memory,
as 14 million voters head to the polls on Saturday to decide who runs the country for
the next three years.

A Nielsen poll, published by Fairfax on Saturday, shows Prime Minister Julia Gillard's
Labor government ahead of Opposition Leader Tony Abbott's coalition on a two-party-preferred
basis by 52 per cent to 48 per cent.

On primary votes, the coalition's lead is 41.5 to 39 per cent, with the Greens on 13 per cent.

The Weekend Australian newspaper's Newspoll shows an even tighter contest, putting
Labor in front by a marginal 50.2 per cent to the coalition's 49.8 per cent on a two-party-preferred
basis.

Labor's primary vote is 36.2 per cent, with the coalition on 43.4 per cent and the
Greens on 13.9 per cent.

The Newspoll revealed swings against the Gillard government in Queensland and NSW,
where Labor has suffered in its primary vote in the last week of the campaign.

ALP's primary vote in Queensland is down eight percentage points in just three days
to 27 per cent, compared with 42.9 per cent in 2007, the Australian reports.

In NSW, Labor's primary vote is down from 39 per cent to 35 per cent, compared with
44.5 per cent at the last election.

Based on preference flows at the 2007 election, Labor has suffered a 2.5 percentage
point swing away from it since the last election and a 1.8 point swing against it since
last weekend.

A national uniform swing of 2.5 per cent against Labor would wipe out the government's
majority, with the loss of 13 seats, and result in a hung parliament.

The Nielsen poll shows Labor could hang onto government by finishing with between 77
seats and 79 seats, according to an analysis by Fairfax.

It shows Ms Gillard leads Mr Abbott as preferred prime minister by 51 per cent to 40 per cent.

Her 11-percentage-point lead is three points lower than a week ago.

The leaders threw all they had at the campaign on Friday, with Ms Gillard going back
to the future by focusing on the chance of the coalition bringing back the unpopular Work
Choices.

Mr Abbott warned Labor was incompetent and wasteful and did not deserve a second chance.

People turned off by the largely negative, small-target election campaign can't opt
out - they have to cast a vote because voting is compulsory in Australia.

Almost 8000 polling booths will be open around the country, from 8am to 6pm.

Premier ANNA BLIGH has admitted some householders will be financially worse off under
a rejigged Queensland government solar hot water scheme.

The Bligh government was forced to cancel and redesign its solar hot water scheme in
March .. after the federal government changed its program.

Ms BLIGH's announced today the state's new 60 million dollar scheme would provide a
600 dollar rebate to householders .. and one thousand for low-income earners and pensioners.

She's the new scheme will be more expensive for some people.

Poor worker literacy and numeracy is costing the economy millions of dollars.

Fairfax newspapers report Australian Bureau of Statistics data shows almost half of
all working Australians have less than the minimum literacy and numeracy levels required
to meet the demands of everyday work.

The chief executive of Australian Industry Group .. HEATHER RIDOUT .. says some workers
cannot read standard operating procedures .. and use machinery inefficiently .. resulting
in avoidable injuries and accidents .. and in products needing to be reworked and materials
wasted.

Ms RIDOUT said her group's project .. funded by the Department of Education, Employment

friends, neighbours and relatives living alone over Christmas.

Senior citizens living alone often feel isolated and forgotten, especially at Christmas,
The Salvation Army says.

The Salvos are calling on everyone to make the effort to keep in touch with elderly
people they know over the Christmas/New Year summer holiday period.

"For many older persons, the combination of growing older and living alone creates
a situation in which individuals are less likely to experience social contact with others,"

Salvation Army spokeswoman Rhonda Gregory said on Tuesday.

"If you have a friend or relative who is living alone make a point of keeping in contact
on a regular basis to see how they are. Just a simple call can help greatly."

Ms Gregory said people could do simple things such as encouraging elderly neighbours
to raise a blind each day to show they were okay, or offer to help with routine tasks
such as collecting mail or bringing the garbage in and out.

The father of a teenage girl who died in a Sydney hospital after a golf ball struck
her in the head .. says people admitted to public hospitals in non-life threatening conditions
are at risk.

WARREN ANDERSON's given evidence this morning to the special commission of inquiry
into acute care services in NSW public hospitals.

The emotional father lambasted the system over the circumstances which led to the death
of his 16 year old daughter VANESSA.

He read a letter from a neurosurgeon who resigned from Royal North Shore two months
before VANESSA'S death .. because administrative bottlenecks were sabotaging the system.

Mr ANDERSON told the inquiry patients whose lives weren't at risk were the most vulnerable
.. but people in intensive care were most likely to receive exceptional treatment.

He said procedures for middle range patients should be standardised across the state
.. to help doctors and nurses who rotate from one hospital to another.

A 94-year-old woman .. who's the world's oldest recipient of a masters degree .. has
been named South Australia's adult learner of the year.

PHYLLIS TURNER only enrolled at university at the age of 70 .. after originally leaving
school when she was 12.

At age 75 she was awarded a bachelor of arts at Adelaide University .. and then in
2002 graduated with an honours degree in anthropology.

Ms TURNER completed her masters in medical science in July this year.

learner award.

Fed: Bell Shakespeare Co. gets $1million for regional education

SYDNEY, April 17 AAP - The Bell Shakespeare Company has been given $1 million to expand
its education program throughout regional Australia.

The government grant will better equip the acclaimed touring theatre company's face-to-face
workshops and provide additional resources for teachers to bring the words of Shakespeare
into a contemporary context for students.

It was announced at the Sydney Opera House today by the federal Minister for Education,
Science and Training, Julie Bishop.

She said such programs challenged students to attain higher standards of literacy,
understand the rich diversity of the English language and investigate the timeless themes
of humanity explored by the Bard.

Bell Shakespeare will now be able to visit a minimum of 70 regional schools classified
under the Country Areas Program (CAP) next year.

The company's founder, John Bell, said he was "uplifted" by the government support.

The students and teachers of regional Australia would be those to benefit most from the
funding.

"Bell Shakespeare has actively built a national program of excellence in Shakespeare
and education over the past 17 years," he said.

The company will attempt to match the government's contribution with donations from
the private sector.

Fed: Labor seeks Qantas guarantees on jobs and security

ADELAIDE, Dec 15 AAP - Labor wants Qantas to guarantee the future of its Australian
workforce and its own survival with current debt levels.

Opposition Leader Kevin Rudd says Labor also wants Qantas to guarantee it will remain
an Australian-based company that won't be "broken up into small bits".

Qantas Airways yesterday accepted an $11.1 billion takeover bid from an international
consortium, subject to a national interest test by the Foreign Investment Review Board.

The buyers have pledged not to break up the national carrier but Mr Rudd said Labor
wanted more assurances, particularly about debt levels, job security and the airline's
security role.

"This proposed acquisition is hugely comprised of debt," Mr Rudd told reporters in
Adelaide today.

"What I'm concerned about, and we need some assurances of, is this corporation's ability
to sustain that level of debt into the future.

"It's (Qantas) a very big Australian company, it employs 35,000 Australians, it's one
of the largest providers of apprenticeships in the country - we have got a national interest
in making sure this company has a viable future."

Mr Rudd said the airline industry was a "highly volatile business".

"Let's get some guarantees from the new management of Qantas, the new ownership of
Qantas, (that) its debt burden is not such that it will impede this company's ability
to survive and thrive into the future when it comes to those future shocks which are almost
unique to the airline industry," he said.

Mr Rudd said Labor wanted Qantas to guarantee it would remain Australian based, won't
be broken up, would continue offering regional services, and that the airline would still
be available for use in national security emergencies.

Qantas chief executive officer Geoff Dixon has said the airline would still be available
to transport Australians from the world's trouble spots.

Chin Peng

Chin Peng (real name Won Man-wa, otherwise Ong Boon Hua) (b. Sitiawan, Perak, c.1921) Malaysian; secretary-general of Malayan Communist Party/Communist Party of Malaysia 1947– Chin Peng, whose father ran a small bicycle business, attended Chinese and English schools in Perak and joined the Malayan Communist Party in 1940. During the Japanese occupation (1941–5) he became secretary of the Perak State Committee of the MCP, a member of the Central Military Committee, and leader of the 5th regiment of the Malayan People's Anti-Japanese Army. He liaised with British officers of Special Operations Executive Far East (Force 136) and was later awarded the OBE.

After the British reoccupied Malaya in September 1945 he joined the MCP's Central Executive Committee. Although he was the lieutenant of its secretary-general, Loi Tak, he became frustrated with the party's slow progress and eventually unmasked Loi Tak as a double-agent. After Loi Tak fled in March 1947, Chin Peng became secretary-general and in March 1948 abandoned the ‘united front’ strategy for armed struggle. In June the British declared a State of Emergency which lasted until July 1960.

The Communists adopted Maoist techniques, deploying 4,000–5,000 guerrilla fighters, supported by a network of food and intelligence gatherers, in order to undermine colonialism and establish liberated areas. Although it held down many more British, Commonwealth, and Malayan forces, the Chinese-dominated Communist movement was unable to achieve lasting control over rural Malaya: it lacked significant outside assistance, failed to attract Malay support, and was starved of supplies by the counter-insurgency of Generals Briggs and Templer. Losing the shooting war, in December 1955 Chin Peng attempted to gain political recognition at the Baling talks with the recently elected Chief Minister of Malaya, Tunku Abdul Rahman, but returned to the jungle empty-handed.

By the time Malaya achieved independence (31 August 1957), Chin Peng's force of some 450–500 had retreated to the Thai border from which sporadic incursions were launched. After 1968 the MCP (renamed the Communist Party of Malaysia) split three ways: the CPM, the CPM (Revolutionary Faction), and CPM (Marxist-Leninist). Insurgency revived in urban areas in the 1970s and in the mid-1980s, but by then Chin Peng was living in southern China. In December 1989, as the Cold War ended, Chin Peng returned to southern Thailand to conclude an agreement with the government of Malaysia, whereby the Communists disbanded their military units in return for assistance in peaceful resettlement. At the same time Chin Peng vowed that he was still a Marxist-Leninist.

US-based software company Equator and Moonlight Cordless, an Israeli tech company, have announced a full resolution and low-bitrate MPEG-2 real-time encoder, understood to be an advance on MPEG-4 technology, for Equator's broadband signal processor devices, reports internet.com

The software technology companies said that the solution provides superior video quality at a lower bitrate while complying with standards. Equator and Moonlight added that the solution is compatible across various video platforms, from PVRs to digital set-top boxes.

Internet.com reports that the standard of video resolution quality the programme provides has prompted the companies to market it as an alternative to fixed-function, hard-wired MPEG-2 codec solutions or even MPEG-4.

"We put our open programmable platform to its best use to deliver the best of both worlds - an MPEG-2 implementation that maintains full standards compliance and delivers dramatically lower bitrate and better picture quality," Equator head Avi Katz told the online publication.

Moonlight said that the D1 real-time MPEG-2 encoder supports bitrates ranging from 1Mbps-8 Mbps.

ULMAN URGES RESIDENTS TO BE VIGILANT IN REVIEWING VERIZON OFFERS AND CHARGES.

ELLICOTT CITY, MD -- The following information was released by Howard County (Maryland):

Howard County Executive Ken Ulman announced today that the County's Office of Consumer Affairs is investigating telephone sales practices employed by Verizon in selling bundled television, internet and telephone service. The inquiry was launched after the Office received several consumer complaints.

Ulman is urging residents to exhibit caution when purchasing packaged services through a telephone solicitation. "Verizon and other providers advertise all the bells and whistles of their new technologies, but the information they convey and how it's marketed makes it incredibly complicated for consumers to purchase only the programs and services they actually want and need," said Ulman.

Rebecca Bowman, Administrator of the Office of Consumer Affairs, advises consumers to "take detailed notes while talking with sales agents about the options being offered." Verizon offers "bundles" of up to four services (TV, internet, land-line telephone and wireless telephone), as well as a number of packages and options to choose from. "That is a lot of information to keep track of," said Bowman.

According to the Office of Consumer Affairs, telephone sales representatives usually start by running consumers through the myriad of bundles and options available. These bundles may sound simple at first but when the sales rep gets into the details, consumers can easily become confused. For example, when discussing the TV portion of a bundle, consumers may find that the price option that fits their budget has a limited selection of channels included. When consumers ask about the inclusion of specific channels, they are often told that select channels cannot be added 'a la carte' and that they will have to upgrade to a more expensive bundle that includes a number of other channels they are not interested in purchasing. If consumers balk, they may be told they can stay with the original bundle but add-on a specialized package, for example a sports package, with a different group of extra channels. Consumers who appear reluctant may be offered a special discount to help offset the extra cost.

While consumers are quoted specific prices for bundles and packages, they should keep in mind that the Verizon representatives have the power to offer various discounts and price adjustments. "It's not that different than purchasing a car," says Bowman.

"If you multiply that scenario by four to include discussion of internet, land-line and wireless telephone services, it's usually overwhelming," says Bowman. "Consumers who do not keep notes can easily forget significant parts of the verbal offer."

Consumers need to compare their notes to any "confirmation" e-mails or letters they later receive from the company as well as their first several bills to ensure all details discussed in the telephone transaction are accounted for and that the price is accurate. Consumers also need to be vigilant in reviewing communications that claim to confirm the purchase of add-on services such as game packages, virus protection or tech support that the consumer did not agree to purchase.

When consumers find the confirmation information does not match the telephone agreement, it is important for them to address the discrepancy with the company as soon as possible - and be prepared to walk away from the deal if the company fails to make good on its original offer.

"Addressing such problems takes determination," says Bowman. "After spending 30 to 40 minutes negotiating the original deal, many consumers simply can't bear the thought of having to spend more time fighting with the company. Unfortunately, too many consumers just give up believing that it is not worth their time and energy to save a few dollars."

In a recent complaint, however, a County consumer would have been charged more than $1,000 above the price of agreed-to services over the course of a year. The Office of Consumer Affairs is urging County residents to file complaints about these and other Verizon sales practices. "The more we hear about the problems that consumers have in purchasing Verizon services, the better able we are in addressing those problems with the company," said Bowman.

Immigration law ruling raises employer fears; Legal patchwork could arise after high court decision.

A U.S. Supreme Court decision upholding an Arizona immigration law could result in employers facing a patchwork of onerous anti-immigration laws unless Congress decides to take action, attorneys say.

Furthermore, the court's 5-3 decision last week in Chamber of Commerce of the United States of America et al. vs. Michael B. Whiting et al. gives implicit approval to a sometimes unreliable federal immigration verification system, which also can cause problems for employers, observers say.

In its ruling, the high court upheld lower court rulings that found that Arizona's 2007 Legal Arizona Workers Act is not pre-empted by federal law.

Under the Arizona law, employers that violate the law a second time by knowingly hiring an illegal immigrant can lose their business license.

The Arizona law requires that after hiring an employee, all Arizona employers must verify their employment eligibility using E-Verify, according to the ruling.

Congress established E-Verify, an Internet-based system under which an employer can verify an employee's work authorization status, in the 1996 Illegal Immigration Reform and Immigrant Responsibility Act.

In ruling on the Arizona law, the high court said the 1986 Immigration Reform and Control Act expressly pre-empts "any state or local law imposing civil or criminal sanctions (other than through licensing and similar laws) upon those who employ, or recruit or refer for a fee for employment unauthorized aliens."

According to the opinion, the U.S. Chamber of Commerce had argued "that the Arizona law's provisions allowing the suspension and revocation of business licenses for employing unauthorized aliens were both expressly and impliedly pre-empted by federal immigration law, and that the mandatory use of E-Verify was impliedly pre-empted."

But the Supreme Court disagreed. The majority said the Washington-based Chamber of Commerce "and the United States as amicus argue the Arizona law is not a 'licensing' law because it operates only to suspend and revoke licenses rather than to grant them." However, the high court ruled, "this is contrary to the definition that Congress itself has codified.It is also contrary to common sense. There is no basis in law, fact or logic for deeming a law that grants licenses a licensing law, but a law that suspends or revokes those very licenses (is) something else altogether."

Arizona's procedures "simply implement the sanctions that Congress expressly allowed Arizona to pursue through licensing laws," the majority ruled, saying the state "went the extra mile in ensuring its law closely tracks (the Immigration Reform and Control Act's) provisions in all material definitions."

Consistent with law

On the E-Verify issue, the high court ruled that Arizona's requirement that employers use it "is entirely consistent with the federal law.In fact, the federal government has consistently expanded and encouraged the use of E-Verify," the high court ruled.

The Chamber of Commerce and Justice Stephen Breyer, in his dissenting opinion, argued that employers "will err on the side of discrimination rather than risk the 'business death penalty' by 'hiring unauthorized workers.'"

However, the majority, in the opinion written by Chief Justice John Roberts, responded by saying license termination "is not an available sanction" for simply hiring unauthorized workers, and only "far more egregious violations of the law trigger that consequence.An employer acting in good faith need have no fear of the sanctions."

Justice Elena Kagan did not participate.

Reacting to the ruling, the Chamber of Commerce's National Chamber Litigation Center issued a statement that said, in part, the decision "does not give states or local governments a blank check to pass any and every immigration law," which "continues to be predominantly a federal concern."

David A. Selden, a partner with the Phoenix-based Cavanagh Law Firm P.A., who filed the original lawsuit on behalf of two Arizona business groups, said the decision in the immediate future "is going to result in a lot of states enacting a lot of different immigration laws with penalties against employers."

In the longer term, it "will increase pressure on Congress to reform federal immigration laws, because having a patchwork of 50 different immigration laws in the different states is burdensome for large and small businesses to have to worry about complying with," Mr. Selden said.

This is a "wake-up call" to Congress, said Elena Park, a member of Cozen O'Connor P.C. in West Conshohocken, Pa.

The decision "also shows the importance" of employers conducting self-audits and "by having comprehensive hiring practices so they're prepared" if there is workforce enforcement action, said Mr. Selden.

E-Verify concerns

Observers say one major concern is the ruling's implicit endorsement of E-Verify, which is a voluntary federal system, but mandated by Arizona law. Mississippi, Utah and Virginia also have such a mandate, according to the ruling.

John Doran, a shareholder with Greenberg Traurig L.L.P. in Phoenix, said, "The obligations that are required under Arizona law, including a mandatory use of E-Verify, create significant burdens for employers and, frankly, you wonder if all of a sudden, you have a national E-Verify mandate" as a result of the ruling.

Observers say the E-Verify system is flawed and prone to error. "It isn't quite as effective as people might think it is," said Craig Peterson, an attorney with Dorsey & Whitney L.L.P. in Minneapolis.

"They do get it wrong, and when they do get it wrong, there are serious consequences," said Robert Whitehill, a partner with Fox Rothschild L.L.P. in Pittsburgh, of the E-Verify system.

Furthermore, Mr. Whitehill said, "I think it's entirely possible that (the ruling) will have a discriminatory effect." The ICRA achieved a "balance between thwarting undocumented workers and thwarting discrimination; and now that balance, I think, has been tipped in a way that there'll be more of an impetus for employers to discriminate, which I think is unfortunate."

David Grunblatt, a partner with Proskauer Rose L.L.P. in Newark, N.J., said employers "will err on the side of compliance, even if it violates the rights of the individual, because their bigger fear" is of the state government.

comScore, a supplier of solutions to measure the digital world, has released a white paper, entitled, "The Impact of Cookie Deletion on Site-Server and Ad-Server Metrics in Latin America: An Empirical".

In a release, the Company said that the study addresses the sources of discrepancy between server-based and panel-based data and reveals that cookie deletion can lead to large overstatements in server logs' measurement of the size of online audiences. Without appropriate adjustments, server-based audience reports can be inflated up to 2.5 times the actual number of unique visitors. The study analyzes behaviors in Latin America, including individual market analysis for Argentina, Brazil, Chile, Colombia, Mexico, Peru and Venezuela.

The report revealed the following key findings for the Latin America market:

- Approximately 33 percent of Internet users delete their first-party (i.e. web site) cookies in a month. Third-party (i.e. ad server) cookie deletion rates are even higher than first-party deletion rates, with nearly 43 percent of Internet users deleting their third-party cookies in a month.

- "Serial cookie deleters" have a profound impact on inflating site-server logs because they represent a small percentage of computers, but a very large share of observed cookies.

- Because of the high rate of cookie deletion, a server-centric measurement system which uses cookies to measure the size of a site's visitor base will typically overstate the true number of monthly unique visitors by a factor of up to 2.5x in Latin America.

- Similarly, the study found that an ad-server system which uses cookies to track the reach and frequency of an online campaign will overstate monthly reach by a factor of up to 5.2x and understate frequency to the same degree.

- Comparing cookie deletion rates across individual Latin America markets, the study reported third-party cookies being deleted by 42-45 percent of computers per month, with first-party deletion rates in excess of 30 percent in each country. Argentina exhibited the highest rates of cookie deletion for both first-party and third-party cookies at 36 percent and 45 percent of Internet users, respectively.

Comcast Names Former FCC Commissioner Rachelle Chong as Regional Vice President of Government Affairs for California.

LIVERMORE, Calif., April 28, 2011 /PRNewswire/ -- Comcast has named former Federal Communications Commission (FCC) and California Public Utilities Commission (CPUC) Commissioner Rachelle Chong as Regional Vice President of Government Affairs for California, it was announced today by Curt Henninger, Regional Senior Vice President for Comcast California. Chong will report directly to Henninger, and will oversee all aspects of Comcast's governmental affairs activities, as well as all cable and telecommunications policy matters, throughout the state. She will be based in the company's Livermore, California office, and replaces Johnnie Giles who was recently named Executive Director of External Affairs at Comcast's corporate headquarters in Philadelphia.

Chong has the distinct honor of being the first Asian American to serve as a FCC Commissioner and the first Asian American CPUC Commissioner. She was appointed to the FCC by President Clinton in May, 1994, and served on the FCC until November, 1997. While at the FCC, Chong worked on the implementation of the Telecommunications Act of 1996, digital television transition rules, children's television, the first spectrum auction rules, and services rules for many new wireless services.

California Governor Arnold Schwarzenegger appointed her to the CPUC in January, 2006 and she was reappointed in December, 2008. At the CPUC, Chong led broadband initiatives and regulatory reform in the communications area, including implementation of the state's first video franchise law. She also led the CPUC's smart grid, electric vehicle, demand response and dynamic pricing energy initiatives.

Following her stint at the FCC and prior to joining the CPUC, Chong served as a partner with the International law firm of Coudert Brothers in San Francisco and Palo Alto, leading its West Coast Telecommunications and Internet Practice Group. She then went on to serve as the General Counsel & Vice President, Government Relations of Broadband Office, Inc., a Kleiner Perkins-funded broadband, communications, and applications service provider start up. In that role, Chong was responsible for a 14-person Legal and Government Affairs team, Human Resources and Real Estate Operations Department.

After her CPUC service, Chong was appointed by the Governor to be Special Counsel, Advanced Information and Communications Technologies, for the California Technology Agency. In this capacity, she led broadband, digital literacy, and public safety communications initiatives for the state, and advocated before the Federal Communications Commission, the Department of Commerce, and Congress on communications policy matters.

Chong brings 27 years of experience to her new position. She began her career in 1984 practicing communications law before the Federal Communications Commission and the California Public Utilities Commission with the law firms of Kadison Pfaelzer in Washington D.C. and Graham & James in San Francisco. In 1991, Chong became a partner at Graham & James. Her clients included broadcasters as well as cellular phone and paging companies.

Chong serves as a Board Member of California Telehealth Network (CTN) and is the Chair of the Panel of Expert Advisors for California Emerging Technology Fund. She is also co-Chair of the Federal Communications Bar Association, Northern California Chapter.

Golfsmith: Golf Balls on a Roll with Holiday Shoppers.

The number one holiday gift for golfers this year is golf balls, according to Golfsmith, a golf specialty retailer, which expects to sell more than two million of them in two months.

During the eight weeks leading up to December 25th, the golf retailer said it is gearing up to also sell more than four million golf tees, 80,000 golf shirts and 70,000 golf gloves along with millions of other items.

Genelabs Receives Broad Patent For Gene-Regulating Drugs

Patent Covers Therapeutic Methods for Potential New Class of Drugs

Ryanair's [pounds sterling]50 luggagecheck-in.

BUDGET airline Ryanair is set to charge passengers up to [pounds sterling]50 to check in their bags from next year.

It is a first step towards banning luggage in the aircraft's hold and scrapping pre-flight check-ins.

Ryanair aims to cut [pounds sterling]33million a year off airport costs by forcing passengers to go straight to the departure gate with hand luggage only and boarding passes they printed out from the Internet.

Ryanair chief executive Michael O'Leary said the restrictions will be phased in over three years. He added:'If people feel they must take a lot of luggage, they can fly with our higher-fare competitors.' The airline has raised the handluggage limit from 7kg to 10kg.

South Dakota Land-Conservation Program Gets More Selective.

Sep. 8--South Dakota farmers didn't fare well in efforts to enroll land in the latest Conservation Reserve Program sign-up period.

Only 16.5 percent of requests from the state were accepted.

Loren Schaller of the Farm Service Agency office in Aberdeen said much of South Dakota, including the northeast corner of the state, didn't have the type of land the federal officials wanted to enroll in CRP. Schaller said "environmentally sensitive land" is what they were looking for. This area doesn't have a lot of highly erodible land home to endangered species, he said.

In past sign-up periods, South Dakota farmers have fared considerably better, sometimes getting more than half their acres enrolled, FSA officials said.

In Brown County, only one contract offer for 10.6 acres was accepted.

According to the FSA, South Dakota, North Dakota, Montana and Texas have had higher-than-usual acceptance rates in the past. And, only 39.2 million acres of land nationwide can be enrolled in CRP. As the total is approached, officials must be more selective.

As of July 30, there were 34,117,275 acres of CRP land nationwide.

CRP pays property owners to not farm land if it's environmentally sensitive or beneficial to wildlife. The contracts to enroll land in the program typically extend for 10 or 15 years.

Wildlife wasn't weighed as highly in 2003 as it was in past years, Schaller said. That's a blow to hunters who benefit from wildlife on the state's CRP land. Pheasant hunting on CRP land is very popular because the property has good habitat for the birds.

The criteria federal officials used to select CRP acres were:

--Water quality benefits from reduced runoff.

--On-farm benefits of reduced erosion.

--Wildlife habitat cover.

--Enduring benefits.

--Air quality benefits.

--Cost.

"Compared to prior general sign-ups... some greenhouse gas issues such as carbon sequestration" were considered more than in the past, according to the FSA Web site.

Nationwide, the USDA enrolled 2 million new acres of CRP land.

About 4.1 million acres were offered in the sign-up period that ended in June.

In South Dakota, 334 of 2,202 offers were accepted. They amounted to 29,628 of a possible 178,350 acres.

With 293,634, Kansas easily had the most acres enrolled in the latest CRP sign-up. The next closest state was Washington with 154,765.

In all, there are more than 1,435,000 acres of CRP land in South Dakota. Of that, 23,521 acres are in contracts that expire this month.

The national average payment per CRP acre is $56.53. In South Dakota, the total is only $33.16. Iowa has the highest per-acre rate at $101. A number of factors are taken into account to determine the rental rate, the main one being soil quality.

In Brown County, the average rental rate is about $48.

Most producers have already been notified by the USDA if their acres have been enrolled in the latest CRP sign-up. Most of those contracts are for 10 years.

There's talk that the USDA will announce another signup period as early as next year.

Boku Teams with O2 and mpass in Germany for Direct Mobile Billing.

Telefonica O2 Germany, a provider of broadband and mobile services, and Boku Inc., a company focused on online mobile payments, announced a direct carrier billing relationship.

The Company said O2 customers can now use Boku's payment platform to purchase virtual and digital goods ranging from .09 Euros to 30.00 Euros. O2 customers pay for goods by entering their mobile number and charging directly to their mobile phone carrier bill.

O2 is part of Telefonica, a global provider of broadband and mobile services. O2's mpass system allows direct carrier billing for the purchase of virtual, digital and physical goods.

According to a release, this new partnership integrates the Boku mobile payments platform into O2 Germany's operator billing interface, enabling the following features:

-Support for one-off and subscription payments in Germany

-Full pricing granularity from .09 Euros to 30.00 Euros

-Web Billing support
